Mediation is a conversation or series of conversations facilitated by a neutral person with expertise in conflict resolution. Mediation can take place in the context of existing court proceedings or it can take place among people who are in a dispute, but do not want to start or have not yet started court proceedings. Mediation can also take place in the context of a family, business, organization, or community group where issues have arisen that need to be talked about, but no one is even considering court proceedings.
The purpose of mediation is for the parties, and their lawyers, to step out of the adversarial process for a facilitated, confidential, and without-prejudice discussion with structure and support from a conflict resolution professional.
