Mediation can take place in the context of existing court proceedings or it can take place among people who are in a dispute, but do not want to start or have not yet started court proceedings. Mediation can also take place in the context of a family, business, organization, or community group where issues have arisen that need to be talked about, but no one is even considering court proceedings.
